It is, of course, possible to lift the mentioned consistency condition between the reference embeddings and the subentity relation. Unfortunately, this statement is only true, because entities of higher codimension are almost exclusively used during communication and the geometry is not needed at this point. If anybody uses this condition, we would be breaking code.
However, I also think that you oversimplify things. Subentities of higher codimension are currently not required to have a unique "orientation", i.e., depending on the way you create the entity pointer, the "orientation" might be different. Removing this constraint, the user might come to think that this "orientation" is unique.
>From my point of view, this discussion has been boiling under the surface for too long and should be discussed on a developer meeting. I don't think this issue is a showstopper for UG implementing all subentities. Similar to some checks for Alberta, we can specially disable it for UG.
